Terms of service

These terms cover your use of Tadalal — the website, the merchant portal, merchant storefronts, the driver app and the Merchant API. By creating an account or using the service you agree to them.

01Who we are

Tadalal is a delivery and commerce platform operated in the State of Kuwait by Makinzi Consumer Goods Delivery Company (“Tadalal”, “we”, “us”).

Where these terms say “merchant” they mean a business that uses Tadalal to sell or deliver; “driver” means a person who delivers orders through the Tadalal driver app; “customer” means a person who receives or orders goods.

02Accounts

You must give accurate information when you register and keep it up to date. Merchant and driver applications are reviewed, and we may decline or close an account that does not meet our requirements.

Keep your password and API keys confidential. You are responsible for activity under your account until you tell us it has been compromised.

03Delivery orders and pricing

Delivery fees are set per zone. You see the fee before you confirm each order. The fee is taken from your prepaid delivery wallet once, when the driver confirms pickup.

Delivery times shown in the platform are estimates. We assign the nearest available driver, but timing depends on traffic, preparation time and the accuracy of the addresses you provide.

04Wallet, payments and cash on delivery

Merchants top up their delivery wallet with KNET. Every top-up and debit appears in the transaction history with a receipt.

Card payments are processed by KNET and the participating banks; Tadalal does not store card numbers. Cash collected by drivers on delivery is recorded against each order and settled to the merchant according to the settlement schedule in the merchant portal.

05Merchant responsibilities

Merchants are responsible for the goods they sell, their prices, descriptions, storefront content and compliance with the laws that apply to their business, including food safety and consumer protection.

Goods must be ready, packed and labelled for transport at the time agreed. We do not carry goods that are illegal, dangerous or require special licences unless agreed in writing.

06Drivers

Drivers must hold a valid licence for their vehicle, follow traffic law and handle goods and cash with care. While online, the driver app shares the driver’s location so orders can be assigned and tracked.

07Problems with a delivery

Report a late, damaged or missing delivery through the contact page with the order number as soon as possible. We investigate every report and, where Tadalal is at fault, agree a resolution with the merchant.

08Acceptable use

Do not misuse the service: no unlawful activity, no attempts to access other accounts or data, no interference with the platform’s security, and no automated access except through the Merchant API with your own keys.

09Liability

To the extent permitted by the laws of Kuwait, Tadalal is not liable for indirect or consequential losses, and our liability for any delivery is limited to the value stated for that order. Nothing in these terms limits liability that cannot be limited by law.

10Changes and termination

We may update these terms; the date at the top of this page shows the latest version, and material changes are announced in the portals. You may close your account at any time; we may suspend accounts that break these terms.

11Governing law

These terms are governed by the laws of the State of Kuwait, and the courts of Kuwait have jurisdiction over any dispute.
